$3.2 Million Settlement – Negligent Security, Murder

A negligent security wrongful death case settled for $3.2 million after a resident was shot and killed at his complex while he was returning home.

The claim alleged that the apartment complex failed to address a long pattern of violent crime and property crime on the premises, including aggravated assaults, robberies, rapes, homicides, burglaries, and repeated vehicle thefts, and failed to provide adequate security measures such as proper screening, lighting, security personnel, fencing, and other crime-prevention steps. The case centered on the argument that the fatal shooting was reasonably foreseeable given the property’s extensive crime history and that better safety measures could have prevented the resident’s death.

$2.5 Million Settlement – Medical Malpractice and Wrongful Death

A medical malpractice and wrongful death case settled for $2.5 million after a dialysis patient died from complications related to severe hyperkalemia that allegedly was not treated with the urgency the situation required.

The patient suffered from dangerously elevated potassium levels that later rose even further. The claim alleged that the patient was not personally evaluated by doctors, was kept on an unmonitored general floor instead of the intensive care unit, and was not given the standard of care required. He became unresponsive during dialysis and died.

$650,000 Settlement – Assisted Living and Wrongful Death

An assisted living wrongful death case settled for $650,000 after a resident suffered a catastrophic head injury from a fall and was not sent to the hospital for timely medical evaluation, despite obvious trauma and the known bleeding risks associated with her medications.

After the fall, the resident developed a large bump on the resident’s head, facial abrasions, swelling, and rapid decline, yet the facility failed to ensure proper nurse or physician assessment, failed to notify the correct decision-makers, and continued giving medicinal treatment after the head trauma. Days later, the resident was finally transported to the hospital, where the resident was diagnosed with a large brain bleed (hemorrhage). The resident never recovered and died soon afterward, with brain bleed from a fall listed as the cause of death.

$475,000 Settlement – Medical Malpractice

A medical malpractice case settled for $475,000 after a patient suffered severe complications following a suprapubic prostatectomy. The claim alleged that errors during the surgery caused devastating injuries and a prolonged decline.

The patient endured painful, disfiguring complications, including urine leaking into his rectum, along with ongoing suffering that affected his dignity, privacy, and daily quality of life. The case centered on allegations that the surgeon’s breach of the standard of care during the procedure directly caused those injuries and their lasting consequences.

$299,995 Settlement – Nursing Home Fall

A nursing home neglect case settled for $299,995 after a short-term rehabilitation patient suffered a catastrophic fall that caused a displaced right hip fracture, followed by serious decline and bedsores.

The resident had been admitted for rehabilitation after a pulmonary embolism and was making strong progress toward returning home. Despite being identified as a high fall risk and requiring extensive supervision and assistance, he was allegedly left unattended in his wheelchair and fell. The injury required operative hip repair and derailed his recovery. He later developed bedsores on both heels, a painful right heel ulcer with odor, sacral and heel decubitus ulcers, generalized weakness, physical deconditioning, and failure to thrive, leaving his wife to manage a far greater level of care than would have been necessary absent the fall.

$268,7500 Settlement – Assisted Living Neglect and Wrongful Death

A wrongful death case involving an 86-year-old assisted living resident settled for $268,750 after a pattern of alleged neglect at the facility ended in a devastating fall and fatal cervical neck fracture.

The resident showed increasing confusion, agitation, and decline during the stay, but the facility failed to reassess the resident’s condition, implement meaningful interventions, update fall precautions, or transfer her to a more appropriate level of care. After an initial fall, the resident suffered a second catastrophic unwitnessed fall inside her apartment, resulting in an acute C6 compression fracture and other traumatic injuries. The resident died days later in hospice care, and the death certificate listed cervical neck fracture and falls as the cause of death.

$250,000 Settlement – Slip and Fall

A premises and transportation injury case settled for $250,000 after a hospital patient fell while trying to board a transport bus after discharge. The client had been released from the hospital wearing a fall-risk armband and using a rollator walker, but the bus driver refused to let her use the wheelchair ramp and did not assist her onto the bus, causing her to fall while attempting to board on her own.

The client suffered a serious left leg injury that developed into Complex Regional Pain Syndrome (CRPS/RSD), a chronic and painful permanent condition. Her treatment included emergency care, repeat hospital evaluation, orthopedic follow-up, physical therapy, and a functional capacity evaluation. She was later assigned a 30% total body impairment rating and now faces ongoing pain, reduced mobility, increased fall risk, and permanent limits on daily activities.

$235,0000 Settlement – Assisted Living Falls

An assisted living neglect case settled for $235,000 after a resident with dementia and increasing care needs suffered a pattern of repeated falls, skin breakdown, incontinence-related injuries, weight loss, and overall decline while in assisted living and hospice care.

After multiple falls, the resident declined significantly in both cognitive and physical functioning. The resident later became nonverbal, bedbound, fully dependent for daily activities, and at high risk for skin breakdown, yet still developed stage II pressure injuries to the coccyx, buttocks, sacrum, and other areas, along with recurring yeast infections, soaked briefs, and preventable moisture-related skin damage. The records also raised concerns about inaccurate assessments, failure to implement hospice instructions, inadequate repositioning, inadequate brief changes, and incomplete clinical documentation. The resident ultimately died from these injuries.

$175,000 Settlement – Nursing Home Neglect and Wrongful Death

A nursing home neglect and wrongful death case settled for $175,000 after a resident’s condition deteriorated through a pattern of catastrophic bedsores, infection, sepsis, gangrene, malnutrition, and preventable decline.

The resident entered the facility after a stroke with limited mobility, incontinence, and known skin breakdown risks, but his condition worsened dramatically during his stay. The resident developed multiple worsening pressure ulcers, including wounds to the left ankle, right heel, sacrum, buttocks, shoulder, and ears, along with wound infection, dehydration, urinary tract infection, sepsis, gangrene, and protein malnutrition. He was ultimately hospitalized in critical condition, underwent a below-the-knee amputation from the gangrene, and later died from the complications.

$90,000 Settlement – Car Accident

A client recovered a $90,000 settlement after a serious head-on crash. The collision happened when the other driver failed to maintain her lane, crossed into the client’s lane and caused a wreck severe enough to flip the client’s vehicle onto its side.

The client suffered multiple rib fractures, a wrist sprain, back injuries, shoulder pain, knee pain, and toe injuries. Her treatment included emergency care, orthopedic follow-up, physical therapy, and lumbar MRI imaging.

$85,000 Settlement – Car Accident

A passenger injury case settled for $85,000 after a violent head-on collision in Cobb County, Georgia, caused by a driver who illegally crossed a double yellow line to pass another vehicle, lost control, and crashed into the vehicle in which the client was riding.

The client suffered neck, back, shoulder, and wrist injuries, including aggravation of pre-existing back and wrist conditions. His treatment included emergency care, primary care follow-up, massage therapy, physical therapy, and spine evaluation.

$70,000 Settlement – Car Accident

A client recovered a $70,000 settlement after being injured as a passenger in a serious head-on crash in Rockdale County, Georgia. The collision happened when the other driver failed to maintain her lane, crossed into the vehicle’s lane and caused a wreck severe enough to flip the vehicle onto its side.

The client suffered neck, back, chest, knee, and shoulder injuries, including disc bulges, a cervical disc herniation, a knee contusion with joint effusion, and soft tissue injuries. Her treatment included emergency care, orthopedic follow-up, MRI imaging, and physical therapy.

Nursing Home Neglect Case Study

Nursing homes have the responsibility to care for those who are too old or too ill to care for themselves. While the vast majority of these facilities are well run and provide compassionate care, there are cases every year that result in injury, suffering, even death for reasons that should have been preventable. Assisted Living Case Study

Yolanda M. nearly died in a personal care home. She fell and broke her hip. She was in pain and unable to get up. There were phones and a panic button in the room, but should could not reach them. The staff of this assisted living facility was supposed to do safety checks every shift. None were done. As a result, this poor woman was left helpless on the floor for so long, her skin was sticking to the floor.

Yolanda's life was never the same afterwards. She never walked again. She was scarred for the rest of her life. But Yolanda had a savior-her sister had the courage to step in. Surgical Error Case Study

While it is true that medicine is not a perfect science, we never consent to negligent care or needless mistakes at the hands of our doctors. Johnson Greer Law Group is dedicated to helping the victims of medical malpractice, and their families, obtain justice and dignity.

Jason L went to his doctor for routine gall bladder surgery. Unfortunately, the doctor simply cut too far and too deep when trying to remove Jason's gall bladder and cut an artery. If not for a more senior surgeon who happened to be on call at the hospital and who came to repair the first doctor's mistake, Jason would have died on the operating table. As it was, Jason had to endure months of painful rehabilitation and was unable to live the active life he used to have.

Fortunately, Jason's family hired Johnson Greer Law Group to take the doctor to trial. Several days into trial, the doctor saw that the case was going badly for him, and he accepted the reality of his mistake and agreed to settled the case. The result didn't bring back the priceless treasures he lost, but it did provide strong compensation for Jason's injuries and pay for the added care he needed to live his life after this catastrophe.

Failure to Diagnose Case Study

We expect medical professionals to exercise all due care when it comes to treating our medical conditions. Unfortunately, some medical doctors fail to provide their patients with the level of care they need. A case we handled in early 2017 illustrates this reality.

Our client, a woman in her early fifties, went to her primary care doctor complaining of numbness and tingling in her left foot and left leg. Over the course of the next year, she went back to the same doctor six different times, with her condition visibly worsening each time. She went from walking normally, to walking with a cane, to barely being able to move at all with a wheeled walker. Yet the doctor continued to insist she was suffering from arthritis or shin splints and did not refer her to a specialist, even though she had no prior history of trauma or surgery that could have explained her symptoms.

When our client was finally evaluated by an orthopedist, her new provider immediately diagnosed a spinal cord injury that was the result of a disc protrusion with central canal stenosis. Unfortunately, this diagnosis was too late to prevent her from sustaining serious, irreversible injuries, leading to permanent disability and partial paralysis.

Our firm immediately went to work to seek fair compensation for this patient. We worked directly with her medical provider and retained a doctor in the same field as her original physician who produced a signed affidavit stating that her care did not meet established standards of care. Although we were fully prepared to take this case to trial, we were able to successfully negotiate and recover a substantial sum for our client within six to eight months – a very short timeframe for this type of medical negligence case – without even filing a lawsuit. Our strong reputation for handling medical malpractice cases was a key factor in reaching this efficient resolution.

The recovery has given our client a new lease on life. With the compensation we recovered, she was able to purchase an accessible home and a reliable vehicle with modifications to accommodate her disability, allowing her to regain much of her independence and quality of life. Negligent Security Case Study

All property owners have a responsibility to keep their premises safe, and that includes providing adequate security. When they fail to do so, people can be seriously hurt, as one case we handled in 2017 shows.

Our client was leaving an organized cookout event when a firefight broke out and she was caught in the crossfire. She was struck by two bullets; one hit her in the face and the other became embedded in her leg. When she was brought to the hospital, doctors were unable to remove the bullet from her leg because of the way it had entered, fearing that they would cause more damage.

Fortunately, she recovered from her injuries and was able to return to her job driving a school bus, but the incident left her with a permanent limp as well as scarring across her nose. She retained our firm to pursue a negligent security case against the club. Despite a long history of similar altercations on the property and adjacent properties, the club had absolutely no security presence, and we were able to prove that the incident could have been stopped if the club had security in place.

Because we took immediate action in this case, we were able to resolve our client’s situation quickly without the need for depositions or other time-consuming legal procedures. Our client was grateful not only for the compensation we obtained, but also that we were able to take care of her legal needs quickly so that she could focus on her physical recovery and her family.
